Enel North America, Inc. and its affiliates (collectively, our “Company”) are committed to maintaining the confidentiality of Social Security Numbers that we collect in the ordinary course of our business.  Pursuant to applicable laws including Section 501.052 of the Texas Business & Commerce Code, our Company has established this Social Security Number Privacy Policy applicable to Texas residents, which describes how our Company collects and maintains the confidentiality and security of Social Security Numbers collected from Texas residents (“you”).
 

1. How your social security number is collected

Our Company collects your Social Security Number directly from you.  For instance, we collect your Social Security Number when you provide us with an IRS tax form W-9 and/or an ACH payment form containing your Social Security Number in connection with your business transaction with our Company. 

Our Company may also collect your Social Security Number from a third party to whom you provided your Social Security Number, when your Social Security Number is transferred to us as a business asset that is part of a merger or acquisition transaction that our Company enters into with that third party.

2. How and when your social security number is used

Under applicable state and federal law, our Company can only collect and use your Social Security Number if we have a proper reason for doing so. Our Company collects and uses your Social Security Number for one or more of the following business reasons:

  • For processing and making payments to you when due;
  • For complying with our legal and regulatory obligations such as reporting payments made to you to the Internal Revenue Service and sending you any applicable tax forms like IRS form 1099;
  • For internal verification or administrative purposes such as, if applicable, detecting and protecting against any security incidents; and
  • With your consent, for any other lawful purpose.

Our Company may also disclose your Social Security Number to a third party to receive their services for the business reasons described above or to a third party as part of a merger or acquisition transaction that our Company enters into with that third party.

3. Access to your social security number

Our Company restricts access to your Social Security Number to our personnel and authorized third parties who have a legitimate or necessary business reason to access it, except as required by state or federal law, or by court order or rule.  Our Company prohibits the unlawful disclosure of Social Security Numbers, and those who have access to your Social Security Number while it is in our custody or control are subject to a duty of confidentiality.

4.  Protection of your social security number

Our Company will take reasonable steps to maintain the confidentiality and security of your Social Security Number when obtained by us.  We have implemented and maintain reasonable security measures to prevent your Social Security Number from being unlawfully disclosed, accidentally lost, or used or accessed in an unauthorized way. We also have procedures in place to deal with any suspected personal data security breach. We will notify you and any applicable regulator of a data security breach where we are legally required to do so.

5. Disposal of your social security number

At the time of disposal, we will destroy records containing your Social Security Number that are within our custody or control by shredding, erasing or otherwise modifying the Social Security Number in the records to make it unreadable, undecipherable, unusable and nonreconstructable in accordance with applicable law.
